1. Applicability

These terms and conditions apply to all services offered by Sennd.
By using Sennd you agree to these terms.
Sennd reserves the right to amend these terms. Changes will be announced 14 days in advance by email.
If you do not agree to the amended terms, you can cancel your subscription.

2. Payment and invoicing

Subscriptions are billed monthly or quarterly, depending on your chosen plan.
Payments must be made in advance via the payment methods offered by Sennd.
In case of late payment, Sennd reserves the right to suspend your account until payment is received.
After 14 days of non-payment, Sennd may permanently close your account without prior warning.
Upon account closure due to non-payment, all data will be permanently deleted within 30 days.
Payments already made will not be refunded in case of suspension or closure due to non-payment.

3. Subscription and cancellation

Subscriptions are automatically renewed at the end of each billing period.
You can cancel your subscription at any time via your account settings.
Upon cancellation, your account remains active until the end of the paid period.
After cancellation, all data will be permanently deleted within 30 days of the end of your subscription.
Sennd offers a 30-day free trial. After this period, the chosen subscription is automatically activated unless you cancel.

4. Data management and retention

Sennd stores your business data, quotes, invoices and other information for the duration of your active subscription.
Upon termination of your subscription, all data will be permanently deleted within 30 days.
It is your responsibility to back up your data before your subscription ends.
Sennd makes daily automatic backups but is not obliged to make these available after your subscription ends.
You always have the right to access, correct and delete your personal data in accordance with GDPR.
Sennd never sells or shares your data with third parties, except where legally required.

5. Liability and warranty

Sennd provides the software 'as-is' and gives no guarantees of uninterrupted or error-free operation.
Sennd is not liable for damages resulting from the use of the software.
Sennd is not liable for outages, bugs or interruptions in service.
In case of technical issues, Sennd aims to resolve these within 48 hours.
Sennd's total liability is limited to the amount you paid in the past 3 months.
Sennd is not responsible for errors in documents generated by you.

6. Availability and maintenance

Sennd aims for 99% uptime but cannot guarantee this.
Sennd may temporarily interrupt service for maintenance.
In case of emergency maintenance, the service may be temporarily unavailable without prior notice.
Sennd reserves the right to modify the functionality of the software.

7. Use and misuse

You may only use Sennd for legal purposes.
It is prohibited to use the software for illegal activities, spam, or to harm others.
Sennd reserves the right to immediately close accounts that misuse the service.
You are responsible for keeping your login credentials secure.
It is prohibited to reverse-engineer, copy or distribute the software.

8. Intellectual property

All rights to Sennd's software, design and content remain the property of Sennd.
You receive a non-exclusive, non-transferable right of use for the duration of your subscription.
The content you create (quotes, invoices, client data) remains your property.
Sennd may use your content to improve the service but will never share it with third parties.

9. Privacy and security

Sennd takes the privacy of your data seriously and acts in accordance with the GDPR.
We use industry-standard security measures to protect your data.

You always have the right to access, correct, restrict and delete your personal data.

10. Disputes and applicable law

These terms are governed by Dutch law.
Disputes will first be resolved by mutual consultation.
If this does not lead to a resolution, the courts in the Netherlands have jurisdiction.
Sennd aims to handle complaints within 7 business days.
